Since you could be hanged for stealing anything above the value of a farthing, and there are court and jail records of them hanging an 11 year-old girl for stealing a dress, and well over one hundred "offenses" carried the death penalty in the 18th cen, they never lacked for scaffold fodder!
Hmm, could be he's graying, though he didn't seem gray in the promo clip that was unveiled at San Diego Comic Con. Given the sometime quality of these candid shots, hard to say. But it would certainly give Jack even more incentive to find that Fountain of Youth!
